1. Acceptance of Terms

By accessing or using Auckland.kiwi (“the Site”), you agree to be bound by these Terms of Service (“Terms”). If you do not accept any part of these Terms, please refrain from using the Site.

2. Who we are

Auckland.kiwi is a travel and lifestyle website operated in Auckland, New Zealand (“we”, “our”, or “us”). We provide information about attractions, walks, and tours in Auckland and may earn commissions through affiliate links. We do not own or operate any of the tours or activities listed.

3. Scope of Services

  • We publish editorial content, reviews, and guides for informational purposes only.
  • Availability, pricing, and details of tours and activities can change without notice. While we aim to keep information current, we cannot guarantee accuracy or completeness.
  • No booking or payment takes place on Auckland.kiwi; bookings are processed by third-party providers (principally Viator). See section 5.

4. Your Responsibilities

When using the Site, you agree to:

  1. Rely on your own judgement and verify critical details (e.g., safety requirements, age limits, tide times) directly with the provider before booking or participating.
  2. Use the Site for lawful purposes only and not harm, disrupt, or attempt to gain unauthorised access to any part of the Site or its infrastructure.
  3. Respect all intellectual-property rights described in section 7.

5. Bookings via Viator and Other Third Parties

  • Clicking a tour link redirects you to Viator.com (or another provider). Your contract, payment, and any dispute are solely with that provider.
  • Your booking is governed by the provider’s own terms, privacy policy, cancellation rules, and local regulations.
  • We are not a party to the booking contract and accept no liability for the fulfilment, quality, safety, or legality of any third-party service.

Auckland.kiwi includes links to external websites and services—such as SafeSwim water-quality reports, MetService forecasts, public-transport timetables, and regional council pages—for your convenience and general information. We do not own or control these sites (“External Sites”) and cannot guarantee their accuracy, availability, or suitability. Information such as weather conditions, water quality, or safety alerts may change without notice.

By following a link you acknowledge that:

  • The content, policies, and availability of External Sites are outside our control.
  • Any reliance you place on information from an External Site is at your own risk—you should verify current conditions directly with the relevant authority before making decisions such as swimming, boating, or fishing.
  • External Sites may be subject to their own terms of use and privacy policies.

We accept no liability for any loss or damage arising from your use of, or reliance on, information obtained via External Sites.

7. Intellectual Property

  • All original text, graphics, photographs, and other content on the Site are © Auckland.kiwi 2025 unless otherwise stated.
  • You may view, copy, or print individual pages for personal use, but you must not republish, sell, or exploit any Site content without prior written consent.
  • Third-party trademarks and content remain the property of their respective owners.

8. Affiliate Disclosure

Auckland.kiwi participates in the Viator Affiliate Programme and may earn a commission if you make a booking after clicking one of our tour links. This comes at no extra cost to you.

9. Site Availability & Updates

We strive for continuous uptime but do not guarantee that the Site will always be available, error-free, or free from viruses. We may suspend, withdraw, or modify the Site (or any part of it) without notice.

10. Limitation of Liability

To the maximum extent permitted by New Zealand law:

  • We exclude all implied warranties, including fitness for purpose and non-infringement.
  • We are not liable for any loss (direct, indirect, special, or consequential) arising from your use of, or inability to use, the Site or any third-party service.
  • Nothing in these Terms limits any rights you may have under the Consumer Guarantees Act 1993 or Fair Trading Act 1986 that cannot lawfully be excluded.

11. Indemnity

You agree to indemnify and hold us harmless from any claim, loss, or expense (including legal fees) arising from your breach of these Terms or misuse of the Site.

12. Governing Law

These Terms are governed by the laws of New Zealand. Any dispute relating to the Site shall be resolved in the courts of New Zealand, and you consent to the exclusive jurisdiction of those courts.

13. Changes to These Terms

We may revise these Terms from time to time. Updated versions will be posted on this page with a new “Last updated” date. Continued use of the Site after any change indicates your acceptance of the revised Terms.
